These Terms and Conditions ("Terms," "Agreement," or "Terms and Conditions") govern your use of the Soaring High Transportation LLC website and the auto transportation brokerage services provided by Soaring High Transportation LLC ("Soaring High Transportation," "we," "us," or "our").

By requesting a quote, submitting an order, making a payment, booking transportation, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms.

1. COMPANY AND BROKER STATUS

Soaring High Transportation LLC is an auto transportation broker registered with the Federal Motor Carrier Safety Administration ("FMCSA").

Soaring High Transportation LLC does not directly provide motor-carrier transportation services unless expressly stated otherwise.

Our role is to arrange transportation between customers and independent motor carriers that are responsible for the physical transportation of vehicles.

The motor carrier assigned to a shipment is responsible for operating the vehicle transporter, complying with applicable transportation laws and regulations, and physically transporting the customer's vehicle.

FMCSA distinguishes a broker from a motor carrier because a broker arranges transportation rather than directly transporting property. FMCSA

2. QUOTES AND ESTIMATES

Quotes provided by Soaring High Transportation LLC are based on the information supplied by the customer and the transportation market conditions available at the time of the quote.

A quote may be affected by factors including:

  • Pickup and delivery locations

  • Vehicle type

  • Vehicle size and weight

  • Vehicle operability

  • Open or enclosed transportation

  • Requested pickup dates

  • Seasonal demand

  • Carrier availability

  • Fuel prices

  • Route availability

  • Additional transportation requirements

  • Changes to information originally provided by the customer

A quote is not necessarily a guarantee that a carrier will accept the shipment at that exact price.

Unless expressly stated otherwise in writing, a quote represents an estimated transportation cost and may change before a carrier is assigned.

3. CUSTOMER INFORMATION

The customer agrees to provide accurate and complete information when requesting transportation services.

This may include:

  • Customer's legal name

  • Telephone number

  • Email address

  • Pickup address

  • Delivery address

  • Vehicle year

  • Vehicle make

  • Vehicle model

  • Vehicle identification number (VIN), when requested

  • Vehicle condition

  • Vehicle operability

  • Requested transportation dates

  • Special transportation requirements

The customer is responsible for notifying Soaring High Transportation LLC of any changes to the information provided.

Incorrect or incomplete information may result in additional charges, delays, cancellation, or inability to arrange transportation.

4. CARRIER ASSIGNMENT

Soaring High Transportation LLC may arrange transportation through an independent motor carrier that is appropriately registered and authorized for the transportation being arranged.

The assigned carrier may contact the customer directly regarding:

  • Pickup arrangements

  • Delivery arrangements

  • Estimated arrival times

  • Vehicle inspection

  • Loading

  • Unloading

  • Delivery

  • Transportation-related instructions

The carrier is responsible for the actual physical transportation of the vehicle.

Soaring High Transportation LLC does not guarantee the identity of a particular carrier until a carrier has been confirmed and assigned to the shipment.

5. CARRIER INSURANCE

The motor carrier transporting the vehicle is responsible for maintaining applicable insurance required for its operations.

Customers should review the carrier's insurance information and transportation documents when appropriate.

Soaring High Transportation LLC does not represent that its own brokerage insurance provides coverage for physical damage to a vehicle being transported by an independent carrier.

The customer's transportation agreement, bill of lading, and other applicable carrier documents may contain additional provisions concerning insurance and claims.

6. VEHICLE CONDITION

The customer must accurately disclose the condition of the vehicle before transportation.

The customer must disclose whether the vehicle:

  • Runs and drives

  • Rolls

  • Brakes

  • Steers

  • Can be loaded normally

  • Has mechanical problems

  • Has modified suspension

  • Has oversized dimensions

  • Has lowered or raised suspension

  • Has non-functioning brakes

  • Has other conditions affecting loading or transportation

Failure to disclose a vehicle's condition may result in additional charges, delays, refusal of transportation, or cancellation.

7. PERSONAL PROPERTY INSIDE THE VEHICLE

Customers should not place personal belongings inside the vehicle unless expressly permitted by the assigned motor carrier.

If personal property is permitted, the carrier may impose restrictions concerning:

  • Weight

  • Quantity

  • Location

  • Type of property

  • Security

Soaring High Transportation LLC is not responsible for loss or damage to personal belongings placed inside a vehicle.

Customers are responsible for removing valuable, fragile, prohibited, hazardous, or irreplaceable items before transportation.

8. PICKUP AND DELIVERY DATES

Transportation dates provided by Soaring High Transportation LLC are generally estimates unless expressly guaranteed in writing.

Auto transportation involves variables that may affect pickup and delivery timing, including:

  • Weather

  • Traffic

  • Mechanical problems

  • Road closures

  • Carrier availability

  • Government restrictions

  • Construction

  • Delays involving previous shipments

  • Force majeure events

Soaring High Transportation LLC does not guarantee an exact pickup or delivery time unless specifically agreed to in writing.

9. PICKUP AND DELIVERY LOCATIONS

Customers are responsible for providing safe and legal pickup and delivery locations.

If a carrier cannot safely access the requested address because of:

  • Narrow roads

  • Low bridges

  • Weight restrictions

  • Dead-end streets

  • Private roads

  • Construction

  • Local restrictions

  • Inadequate clearance

  • Unsafe conditions

the carrier may require the vehicle to be picked up or delivered at a nearby safe and legal location.

Additional charges may apply where the customer requests services or circumstances outside the original transportation arrangement.

10. VEHICLE INSPECTION AND BILL OF LADING

The customer should carefully inspect the vehicle with the carrier at pickup and delivery.

The carrier may complete a condition report or bill of lading documenting the vehicle's condition.

Customers should:

  1. Review the vehicle condition report.

  2. Identify existing damage.

  3. Confirm the condition of the vehicle at delivery.

  4. Note any apparent damage before accepting delivery.

  5. Retain copies of all transportation documents.

The bill of lading and vehicle condition report are important documents relating to the physical transportation of the vehicle.

11. DAMAGE CLAIMS

Any claim relating to physical damage occurring during transportation should generally be directed to the motor carrier that physically transported the vehicle, because the carrier is responsible for the actual transportation.

Customers should document any alleged damage with photographs and notify the carrier as soon as reasonably possible.

Soaring High Transportation LLC may assist in communicating with the carrier regarding a customer's claim but does not act as the motor carrier or insurer.

Nothing in these Terms is intended to eliminate or restrict any rights a customer may have under applicable law.

12. CANCELLATION

A customer may request cancellation of a transportation order before the shipment is assigned to a carrier.

Cancellation after a carrier has been assigned may be subject to the cancellation terms communicated to the customer at the time of booking.

Any applicable cancellation fees, deposits, or refunds will be governed by the specific booking confirmation or transportation agreement provided to the customer.

The amount and timing of payment will be communicated to the customer before or during booking.

14. ADDITIONAL CHARGES

Additional charges may arise when circumstances differ materially from the information provided when the transportation was booked.

Examples may include:

  • Inoperable vehicles

  • Oversized vehicles

  • Modified vehicles

  • Special loading requirements

  • Incorrect pickup or delivery information

  • Additional mileage

  • Changes requested by the customer

  • Storage

  • Redelivery

  • Waiting time

  • Special equipment

  • Changes in transportation requirements

Any additional charges should be communicated to the customer when reasonably possible.

15. NO GUARANTEE OF CARRIER AVAILABILITY

Submitting a quote request does not guarantee that a motor carrier will accept the shipment.

Transportation availability depends on factors including route, dates, vehicle type, market conditions, and carrier capacity.

Soaring High Transportation LLC will make commercially reasonable efforts to arrange transportation but does not guarantee that a carrier will be available for every requested route or date.

16. CUSTOMER RESPONSIBILITIES

The customer agrees to:

  • Provide accurate information.

  • Provide accurate pickup and delivery addresses.

  • Disclose vehicle condition.

  • Remove personal and valuable belongings unless otherwise authorized.

  • Make required payments.

  • Be available or arrange for an authorized representative during pickup and delivery.

  • Inspect the vehicle at pickup and delivery.

  • Review and sign applicable transportation documents.

  • Follow reasonable instructions provided by the assigned carrier.

  • Notify Soaring High Transportation LLC of material changes to the shipment.

17. PROHIBITED ITEMS

Customers may not use transportation services to transport illegal, hazardous, explosive, or otherwise prohibited materials.

The customer is responsible for ensuring that no prohibited materials are placed in the vehicle.

The carrier may refuse transportation if prohibited or hazardous materials are discovered.

18. DELAYS

Soaring High Transportation LLC is not responsible for delays caused by circumstances outside its reasonable control, including:

  • Severe weather

  • Natural disasters

  • Traffic accidents

  • Road closures

  • Government actions

  • Mechanical failures

  • Carrier delays

  • Labor disruptions

  • Civil disturbances

  • Acts of war

  • Other force majeure events

We will make reasonable efforts to communicate material delays when information becomes available.

19. LIMITATION OF BROKER RESPONSIBILITY

Soaring High Transportation LLC acts as a transportation broker and does not physically operate the truck transporting the vehicle.

Accordingly, Soaring High Transportation LLC is not responsible for acts or omissions of an independent motor carrier to the extent permitted by applicable law.

This includes matters arising from the carrier's:

  • Driving

  • Loading

  • Unloading

  • Vehicle handling

  • Route selection

  • Mechanical condition

  • Delivery operations

  • Driver conduct

This provision does not waive rights or obligations that cannot legally be waived.

20. WEBSITE INFORMATION

We attempt to keep the information on our website accurate and current.

However, website content may contain typographical errors, outdated information, or inadvertent inaccuracies.

Soaring High Transportation LLC reserves the right to correct errors and update website information at any time.

21. THIRD-PARTY SERVICES

Our website may contain links to or integrations with third-party websites, payment processors, communication platforms, carriers, or other service providers.

Your use of our website and services is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

24. INTELLECTUAL PROPERTY

25. FRAUD AND MISUSE

  • Fraud

  • Payment fraud

Nothing in these Terms prevents a customer from exercising rights available under applicable federal or state law.

Any dispute-resolution provisions, including arbitration or class-action provisions, should only be included after they have been reviewed for compliance with applicable law.

27. GOVERNING LAW

These Terms shall be governed by the laws applicable to Soaring High Transportation LLC and the applicable jurisdiction, without regard to conflict-of-law principles, except to the extent superseded by applicable federal transportation law.

28. SEVERABILITY

If a specific written transportation agreement conflicts with these website Terms, the specific agreement applicable to that shipment may control to the extent stated in that agreement and permitted by law.
